Your terms and conditions of use

Article 1 Preamble

On one hand, the brand Madame Choup (hereinafter referred to as “The website” which its headquarters is located in Paris (75018) - 22 rue Norvins, declared under the SIRET number 532997616. -the French business registration number.

Auto-entrepreneur, exempt of registry, according to the article L.123-1-1 of the Code de commerce - French Commercial Code.

VAT free, article 293 B of the CGI - French Code Général des Impôts.

On the other hand, all individuals of at least 18 years old and not merchants, proceeding to make an order on madamechoup.com website, hereinafter referred to as “the customer”.

All orders carried out on the website are subject to these shop policies. The brand Madame Choup reserves the right to adapt and change the shop policies at any time.

The applicable version for any transaction is the one that appears online on the website www.madamechoup.com when the order is made.

If a clause came to be lacking, we consider that it is governed by the procedures in force in the distance sales field.

Madame Choup engages herself to respect all the provisions of the Code de la consommation - Consumer code - in the distance sales field.

 

Article 2 - The Consumer

The consumer declares to be an individual, who is at least 18 years of age and who has the legal capacity or holds a parental consent enabling him or her to make and order on the website.

While the customer registers his/her personal data in the “my account” section, he/her has to ensure the accuracy and completeness of the compulsory data requested. In case there is a mistake in the recipient’s address, the brand Madame Choup cannot be held responsible for failing at delivering the good. The brand Madame Choup reserves the right to cancel any order when the customer’s IP address is domiciled in a different country from the shipping and/or billing address.

The customer declares that the acquisition of these goods are not directly linked with his/her professional activity, their acquisition are meant for a personal use.


Article 3 - The products

Madame Choup sells cooking aprons designed and manufactured in France. All Madame Choup’s aprons are sold in one size that fits all to size 36 to 42 (French Size), (US 2-10) - UK (6-14).

The aprons are 100% cotton and machine washable.

Each item is delivered with an anti-discoloration patch.

Madame Choup is doing her best so that the product descriptions and the photos are the most accurate possible to the product, however, they cannot guarantee an exact similarity with it, especially concerning the colors.

In any case, if the product delivered does not fit the description on the site, the consumer can either exercise his right of withdrawal, or implement Madame Choups’s satisfaction guarantee that gives the right to an exchange or a refund of half or the total amount probably charged.

The product’s availability is clearly indicated on the site, in the product’s description of each item.

 

Article 4 - The Order

Order taking on the website is subjected to the respect of the procedure set up by Madame Choup, represented by a sequence of steps the customer must follow imperatively in order to confirm the order. Before confirming the order for good, the customer will have the possibility to check its details and its total price, to correct the possible errors especially in the shipping address field, then proceed to confirm it as a sign of acceptance. Every order confirmed by the customer is worth a sales contract and acceptance of the present conditions.

Madame Choup will refuse any order from a customer with whom there is litigation or a previous incident on the payment of an order, or who would agree to be bound to the provisions of this agreement.

In this case, Madame Choup will inform the customer by email. If the customer fails to proceed to the correction of the erroneous information with Madame Choup or going against the present shop policies, Madame Choup reserves the right not to proceed the order.

Madame Choup engages herself to send a confirmation email summing up the order (goods, price, quantity, discounts…) to the email address given when the order was made. To that effect, the customer categorically accepts the use of the email address for the order’s confirmation and its content, by Madame Choup.

Article 5 - Pricing

All prices proposed are tax-free (The auto-entrepreneur status involves a VAT exemption, according to the 293B article of the French Code Général des Impôts), and in euro, in addition to which one has to add the processing, shipping and delivery rates, as precised in the article entitled Shippping.

 

Article 6 - Payment

The Internet user can proceed to make his order on this website and pay his order with a credit card (CB, Visa, MasterCard, American Express) or with a PayPal transfer. All credit card payments are made via a secure transaction provided by the service PayPal. This site editor has no access whatsoever to the user’s payment method. The payment is directly processed by the bank.

 

Article 7 - Delivery / Shipping

The orders are shipped with the French postal service - La Poste - worldwide. The shipping is done within a period of 24-72h business days, from the total reception of payment (corresponding to the seller’s counterpart.)

Madame Choup informs the buyer the tracking number when the shipping is confirmed, the buyer can then follow the delivery status of his/her order on the French Post’s website.

The good is delivered to the billing address unless mentioned otherwise in the fields fitting this purpose while making the order.

The customer cannot ask for any compensation in case there is a delay in the delivery caused by the postal carrier. Moreover, in case there is an anomaly at the reception of the delivery (damaged packet, open packet…), the customer will have to file a claim to the carrier within 2 business days through registered mail. One copy of this claim has to be sent to Madame Choup. If the customer is present during the reception of the delivery, he must point out to the delivery man his reservations. This type of shipping problems must be solved with the carrier in priority as Madame Choup cannot be held responsible.

Madame Choup cannot be held responsible for any country specific custom taxes.

Any manufacturing defect or delivery delay exceeding 8 days must be reported to our customer service.

In case the customer gives an incomplete or wrong delivery address, the new delivery will be charged in addition to the order. In case the delivery is offered, the new shipping will be charged. The customer has the possibility to get a refund of his order, minus the shipping actually incurred.

 

Article 8 - Return, withdrawal and refund

The consumer has a seven clear day limit to exercise his right of withdrawal, without having to give a reason nor paying any penalty, with the exception of the cost of returning the goods, from the order’s delivery date, and that will proceed with the return of the item in a new condition (neither worn nor washed) at the consumer’s costs, accompanied by the order number to the following address:

If the seven clear day limit expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.

If the returned goods are incomplete, degraded or made dirty, they cannot be taken back.

The refund of the purchase will take place within thirty days at the latest, after having received the goods. The refund will be made following the same method of payment chosen while ordering.

Article 10 Limited Liability

In the process of online sales, Madame Choup is only bound by an obligation of due care, her responsibility cannot be engaged for any damage resulting from the use of the Internet Network such as the loss of data, intrusion, virus, disruption of service or any other involuntary problem.

The photographs, texts and characteristics - to illustrate the products - are non-contractual and therefore cannot engage Madame Choup’s responsibility.

Madame Choup’s responsibility concerning the sales of products in regard to the buyer is in any case limited to the amount paid by the buyer.

Madame Choup cannot be held responsible for the non-execution of the contract in case the good is not available, in case of force majeure usually recognized by French jurisprudence.

 

Article 11 - Applicable Law

The present general conditions are subject to French law. In case of dispute or complaint, the customer can address himself directly to Madame Choup in order to settle the dispute amicably.

If a clause fails, it is considered to be governed by the distance selling rules in force in France.

 

Article 12 - Data Protection

The collected information by Madame Choup while proceeding to an order is necessary to handle the transaction, and can be communicated -partly or entirely - for this purpose to Madame Choup’s service provider to proceed the orders. According to the French Data Protection Act, the “loi Informatique et Libertés” n°78-17 of January 6th, 1978, the customer has the right to access, to change, to object and delete the data held about him/her.

 

Article 13 - Severability

In case a particular clause is cancelled in the terms of sale, the others remain valid.

The cancelled clause will be replaced following the legal procedure.
